A Disturbing Violation of Human Rights in Brazil: Jair Bolsonaro Faces Relentless Persecution

 
On April 23, 2025, Brazil witnessed an alarming incident that raises serious concerns about human rights and the state of democracy in the country. Former President Jair Bolsonaro, currently in critical condition in the ICU at DF Star Hospital in Brasília, was subjected to an unprecedented act of judicial overreach. While recovering from a grueling 12-hour surgery—his seventh procedure since a near-fatal stabbing in 2018 by a former PSOL militant—Bolsonaro received a court summons from a judicial officer sent by Supreme Court Justice Alexandre de Moraes. The notice demanded that Bolsonaro, despite his grave health, defend himself within five days against ongoing accusations.
Bolsonaro’s health has been fragile for years due to the lingering effects of the 2018 assassination attempt, which left him with severe intestinal complications. His current condition is dire—his intestines have ceased functioning, and the surgery has left him vulnerable, with his blood pressure spiking dangerously upon receiving the summons, putting his life at further risk. Brazilian law explicitly prohibits serving legal citations to individuals in serious medical conditions, a protection meant to ensure basic humanitarian standards. This action, however, appears to disregard both legal and ethical norms, raising questions about the impartiality of the judiciary and its respect for human rights.
 
The timing and manner of this summons have sparked outrage among Bolsonaro’s supporters, who view it as a clear act of political and judicial persecution. At 70 years old, Bolsonaro is unable to respond effectively while fighting for his recovery in a sterile, restricted hospital environment. Critics argue that this move by Justice Moraes—who has been a polarizing figure in Brazil’s political landscape—is part of a broader pattern of targeting Bolsonaro and his allies to silence opposition. Posts on X reflect a growing sentiment that this incident exemplifies an "authoritarian escalation," with many calling the act "inhumane" and "cruel."
This event is not an isolated one. Bolsonaro has long been a target of legal actions, with accusations ranging from his handling of the COVID-19 pandemic to alleged involvement in the January 8, 2023, protests. While some of these cases have been criticized as politically motivated, the insistence on pursuing him during a moment of extreme medical vulnerability crosses a dangerous line. Human rights principles, enshrined in Brazil’s 1988 Constitution and international treaties like the American Convention on Human Rights, emphasize the right to health, dignity, and fair treatment under the law. Serving a legal notice in an ICU setting violates these fundamental protections and sets a chilling precedent for the treatment of political adversaries.
During his presidency (2019–2022), he faced international criticism for policies that organizations like Amnesty International and Human Rights Watch claimed undermined rights, particularly in areas like public health, indigenous protections, and environmental conservation. 
 
However, the narrative of Bolsonaro as a violator of human rights is now juxtaposed with the claim that he himself is a victim of rights abuses. The irony is stark: a man once criticized for dismissing human rights concerns is now having his own rights—particularly his right to health and fair judicial process—apparently disregarded. This duality underscores a deeply polarized political climate in Brazil, where the judiciary, led by figures like Moraes, is seen by some as a guardian of democracy and by others as an instrument of political vendetta.
The international community must take note of this incident. The pursuit of justice cannot come at the expense of basic human dignity, nor should it be wielded as a weapon to suppress dissent. If Brazil is to uphold its commitment to democratic principles and human rights, it must ensure that all individuals, regardless of political affiliation, are treated with fairness and respect—especially in moments of vulnerability. What is happening to Jair Bolsonaro today is a test of Brazil’s democratic integrity, and the world is watching.
